HSRing App Terms of Service

These terms govern your use of the HSRing app, the software on the HandSpring ring, and the cloud services behind them. Buying a ring on this website is covered separately by our Store Terms of Service and Refund Policy. How we handle your data is described in the HSRing App Privacy Policy.

1. Agreement

These App Terms of Service (“Terms”) are an agreement between you and Handspring Technologies Inc. (“HandSpring”, “we”, “us”). By creating an account or using the HSRing app, the ring's software or our cloud services (together, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and accounts

  • You must be 18 or older to use the Service.
  • You sign in with your email address and a one-time code. Keep access to that email account and your phone secure; anyone who can open them can reach your HSRing account.
  • Give us accurate information, and keep your profile details (such as height and weight) up to date so your readings are calculated correctly.
  • One account is for one person. Do not share your account or use someone else's.

3. Wellness only, not medical care

HSRing is a general wellness product. It is not a medical device, and it has not been cleared or approved by the U.S. Food and Drug Administration.

  • Readings, scores, trends and insights, including heart rate, heart rate variability, blood oxygen, temperature, sleep stages and the sleep apnea risk band, are for general information only. They are not intended to diagnose, treat, cure or prevent any disease or condition.
  • Do not use the Service to make medical decisions, and do not start, stop or change any treatment or medication because of it. Talk to a qualified clinician about any result that concerns you.
  • Alerts and notifications depend on your ring, phone, battery and connection, and may be late or not arrive at all. HSRing is not an emergency service. In an emergency, call 911 or your local emergency number.
  • Readings can be affected by fit, movement, skin tone, tattoos, temperature and other factors, and will not always be accurate.

4. Your licence to the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the HSRing app on devices you own or control, and to use the software on your ring, for your own non-commercial use, in line with these Terms.

The app is free to download, and its core features, including sleep, heart rate, HRV, temperature, the morning report and data export, have no subscription fee. We may offer optional paid features in future. If we do, their price and terms will be shown before you buy, and features included with your ring when you bought it will not be moved behind a paywall.

5. Rules for using HSRing

You agree not to:

  • copy, modify, distribute, sell or rent the app or the ring's software;
  • reverse engineer, decompile or disassemble them, except where the law expressly allows it despite this restriction;
  • interfere with, overload or try to gain unauthorised access to the Service or other users' accounts;
  • use the Service to break the law or infringe anyone's rights;
  • use automated means to access the Service, except through features we provide for that purpose;
  • remove or obscure any proprietary notices.

6. Your data

  • Your data stays yours. You give us permission to store and process it only to run the Service for you, as described in the App Privacy Policy. We do not sell it and do not use it for advertising.
  • Cloud backup is optional and needs your consent. Without it, your data stays on your phone and your ring.
  • You can export your data as JSON or CSV, and delete your account in Settings → Privacy & data. Deletion becomes permanent after a 30-day window, as explained in the App Privacy Policy.
  • Keep your own copies of anything you cannot afford to lose. We work to protect your data, but we cannot promise it will never be lost.

7. Updates and availability

  • We update the app and the ring's firmware to fix problems, improve accuracy and add features. Some updates may be required to keep using the Service, and firmware updates are installed through the app.
  • We may change or remove features. If a change takes away something important you rely on, we will tell you in the app first where we reasonably can.
  • The app keeps working without our cloud services, but backup, restore and other online features need them. We aim to keep the Service available, but it may be interrupted for maintenance or reasons outside our control.

8. The ring, purchases and warranty

Orders, payment, shipping, returns and resizing for a ring bought on hsring.com are governed by our Store Terms of Service, Shipping Policy and Refund Policy. Each ring comes with a one-year limited warranty against defects in materials and workmanship, set out in full in the HSRing Limited Warranty; to make a claim, email support@hsring.com with your order number.

9. App Store and Google Play

If you download the app from the Apple App Store or Google Play, the following also applies:

  • These Terms are between you and HandSpring only, not Apple or Google. HandSpring, not Apple or Google, is solely responsible for the app and its content.
  • Your licence to the app is limited to use on Apple- or Android-branded devices you own or control, as permitted by the store's own usage rules.
  • Apple and Google have no obligation to provide maintenance or support for the app.
  • If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
  • HandSpring, not Apple, is responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
  • If a third party claims that the app or your use of it infringes their intellectual property rights, HandSpring, not Apple, is responsible for investigating, defending, settling and discharging that claim.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • You must also comply with any applicable third-party terms, such as your mobile carrier's, when using the app.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

10. Feedback

If you send us ideas or suggestions, we may use them without any obligation to you.

11. Our intellectual property

The app, the ring's software, our algorithms, designs, text and trademarks, including HandSpring and HSRing, belong to HandSpring or our licensors. These Terms do not give you any rights in them other than the licence in Section 4.

12. Ending these terms

  • You can stop using the Service and delete your account at any time.
  • We may suspend or end your access if you seriously or repeatedly break these Terms, if we have to by law, or if continuing would create a real risk of harm to you, other users or us. Where we reasonably can, we will tell you first and give you a chance to export your data.
  • Sections 6, 11 and 13 to 18 continue to apply after these Terms end.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Service will be uninterrupted, error-free or that readings will always be accurate. This section does not affect the ring's hardware warranty or any rights you have that cannot be excluded by law.

14. Limitation of liability

To the fullest extent permitted by law, HandSpring will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or relating to the Service. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for your ring and US$100.

Some jurisdictions do not allow these limitations, so they may not apply to you. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

15. Indemnity

If you use the Service in breach of these Terms or the law, and a third party brings a claim against us as a result, you agree to cover the reasonable costs we incur because of that claim, to the extent permitted by law.

16. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing a claim, please email support@hsring.com so we can try to resolve it informally. Any dispute that is not resolved will be heard in the state or federal courts located in Orange County, California, and you and HandSpring consent to their jurisdiction. This does not take away any right you have to bring a claim in small claims court or in the courts where you live under consumer protection law.

17. Changes to these terms

We may update these Terms. We will announce material changes in the app before they take effect, and the effective date at the top always shows the current version. If you keep using the Service after a change takes effect, the updated Terms apply; if you do not agree, you can stop using the Service and delete your account.

18. General

  • These Terms, together with the App Privacy Policy, are the whole agreement between you and us about the Service.
  • If any part of these Terms is found unenforceable, the rest stays in effect.
  • If we do not enforce a right straight away, we have not given it up.
  • You may not transfer these Terms to anyone else. We may transfer them as part of a merger, acquisition or sale of assets, and your rights under them will not be reduced as a result.
